利用規約 Terms of Service

1. 同意と適用範囲 1. Acceptance and Scope

フロッターをダウンロード、インストール、閲覧、または利用することで、ユーザーは本規約および当社のプライバシーポリシーに同意したものとみなされます。未成年の方は、適用される法律に基づき、保護者または法定代理人の同意を得たうえでご利用ください。

By downloading, installing, accessing, or using Furotter, you agree to these Terms and our Privacy Policy. If you are a minor, you must obtain any consent required by applicable law from a parent or legal guardian before using the app.

2. ライセンスと利用条件 2. License and Permitted Use

当社は、ユーザーに対して、個人的な利用に限定した、非独占的で譲渡や再許諾ができない、取り消し可能なライセンスを付与します。ユーザーは、適用される法令、本規約、Apple App Store の規約、連携する第三者サービスの条件、および第三者の権利を遵守してフロッターをご利用ください。

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the app. You must use the app in compliance with applicable laws, these Terms, Apple App Store rules, third-party service terms, and the rights of others.

3. 禁止事項 3. Prohibited Conduct

以下の行為は禁止されています。

The following activities are prohibited:

• 法令に違反する行為、詐欺、不正アクセス、リバースエンジニアリング、セキュリティの回避、改ざん、解析ツール等を用いた不正な操作
• 広告の表示や効果測定、トラッキング設定、課金処理、サブスクリプションの状態、プレミアム機能の制限、利用回数の制御を回避または妨害する行為
• 他人のQRコードを無断で取得すること、偽のQRコードを作成すること、他人になりすましてプロフィールを共有すること、shareID を不正に利用すること
• CloudKit 上の公開情報、フレンド接続、同期データ、通知処理を不正に操作すること、また他のユーザーに迷惑をかける行為
• 知的財産権、肖像権、プライバシー権その他の権利を侵害すること、有害なコードを配布すること、過度な負荷をかけること、サービスの運営を妨害すること

• Violating laws, committing fraud, unauthorized access, reverse engineering, bypassing security measures, tampering, or manipulating the app through tools or modified environments
• Circumventing or interfering with ad display, ad measurement, tracking controls, purchase flows, subscription states, premium restrictions, or usage controls
• Obtaining another person's QR code without permission, creating forged QR codes, impersonating another user through profile sharing, or misusing shareID data
• Improperly manipulating public CloudKit data, friend connections, sync data, or notification processing, or harassing other users
• Infringing intellectual property, publicity, privacy, or other rights; distributing malicious code; creating excessive load; or disrupting service operations

4. ユーザー情報・自己申告・フレンド共有 4. User Information, Self-Reporting, and Friend Sharing

フロッターの入浴記録、いいわけ、プロフィール表示、フレンドとの共有情報は、すべてユーザー自身の入力や操作に基づくものです。ユーザーは、自分が入力・保存・共有する情報について責任を負い、それを共有するために必要な権利や許可を持っている必要があります。

Bath logs, excuses, profile displays, and friend-sharing information in Furotter are all based on what you enter or control. You are responsible for the information you enter, store, or share, and you must have the necessary rights or authority to share it.

当社は、他のユーザーが共有した情報の正確性、真実性、完全性、最新性を保証しません。QRコードの共有やフレンド接続は、ご自身の判断と責任のもとで行ってください。

We do not guarantee the accuracy, truthfulness, completeness, or timeliness of information shared by other users. You use QR-based sharing and friend linking at your own discretion and responsibility.

5. 課金・サブスクリプション・返金 5. Billing, Subscriptions, and Refunds

• フロッターのプレミアム機能は、Apple App Store を通じた月額または年額の自動更新サブスクリプションとして提供される場合があります
• 価格、通貨、税額、無料トライアルの有無、更新周期、対象となる機能は、購入画面または App Store の表示に従います
• サブスクリプションは、ユーザーが Apple ID の購読管理画面から更新を停止しない限り、App Store の条件に従って自動的に更新されます
• 購入状態の確認と復元には、Apple および RevenueCat の仕組みを利用します
• 返金、請求の取消し、価格変更時の通知、解約の効力発生日は、適用される法令と App Store の規約に従います

• Premium features may be offered as monthly or yearly auto-renewing subscriptions through the Apple App Store
• Pricing, currency, taxes, free trial availability, renewal periods, and included features are as shown on the purchase screen or App Store listing
• Subscriptions renew automatically under App Store rules unless you turn off renewal through your Apple subscription settings
• Purchase verification and restoration use Apple and RevenueCat systems
• Refunds, billing reversals, notice of price changes, and the effective date of cancellation are governed by applicable law and App Store rules

プレミアムプランをご利用中は、現在の実装では少なくとも起動時のインタースティシャル広告が非表示になります。無料プランとプレミアムプランで利用できる機能や表示内容は、今後変更されることがあります。

While your premium subscription is active, the launch interstitial ad is currently suppressed at minimum. Feature availability and display behavior for free and premium plans may change in the future.

サブスクリプションの価格は、事前の通知なく変更される場合があります。価格変更が適用される場合、App Store の規約および適用される法令に基づき、更新時に新しい価格が反映されます。最新の価格は、購入画面または App Store の掲載情報でご確認ください。

Subscription prices are subject to change without prior notice. When a price change takes effect, the new price will be reflected at renewal in accordance with App Store rules and applicable law. Please check the purchase screen or App Store listing for the most up-to-date pricing.

6. 広告と第三者サービス 6. Advertising and Third-Party Services

フロッターは、Apple、CloudKit、RevenueCat、Google AdMob などの第三者サービスと連携しています。当社は、これらの第三者サービスの内容、継続的な提供、可用性、仕様の変更、障害対応、データの保持方針について管理する立場になく、これらを保証するものではありません。

Furotter integrates with third-party services including Apple, CloudKit, RevenueCat, and Google AdMob. We do not control and cannot guarantee the content, continued availability, service levels, specification changes, incident handling, or data retention practices of these third-party services.

7. 知的財産権 7. Intellectual Property

フロッターのアプリ、ソフトウェア、デザイン、商標、ドキュメント、テキスト、画像、データベースなどに関する知的財産権は、当社または正当な権利者に帰属します。本規約によってユーザーに付与されるのは、上記のライセンスのみであり、それ以外の権利が移転されるものではありません。

Intellectual property rights in the app, software, design, trademarks, documentation, text, graphics, databases, and related materials belong to us or our licensors. These Terms grant only the limited license described above and do not transfer any other ownership rights.

8. サービスの変更・停止・終了 8. Service Changes, Suspension, and Termination

当社は、メンテナンス、セキュリティ上の理由、法令への対応、Apple やその他の第三者からの要請、運営上の必要に応じて、機能、価格、広告の提供方法、対応OS、対応端末、利用可能な地域、サポート内容を変更したり、サービスの全部または一部を停止・終了したりすることがあります。

We may change features, pricing, ad delivery methods, supported operating systems, supported devices, regional availability, or support offerings, or suspend or discontinue all or part of the service, for maintenance, security, legal compliance, requests from Apple or other third parties, or operational reasons.

ユーザーが本規約に違反した場合、当社は利用の制限、同期の停止、フレンド機能の制限、課金に関するサポートの停止などの措置を取ることがあります。

If you violate these Terms, we may restrict your access, suspend sync, limit friend features, or refuse purchase-related support.

9. 保証の否認 9. Disclaimer of Warranties

適用される法令で禁止されない範囲において、フロッターは「現状のまま」「利用可能な範囲で」提供されます。当社は、入浴習慣の改善、健康状態の向上、通知の確実な到達、同期の即時完了、他のユーザーが共有する情報の正確性、課金処理の常時成功、広告非表示の恒久性、サービスの無停止運用などについて、明示・黙示を問わず保証するものではありません。

To the maximum extent permitted by law, Furotter is provided on an "as is" and "as available" basis. We make no express or implied warranties regarding improvement of bathing habits, health outcomes, guaranteed notification delivery, immediate sync completion, the accuracy of other users' information, uninterrupted purchase processing, permanent ad suppression, or uninterrupted operation.

10. 責任の制限 10. Limitation of Liability

適用される法令で認められる最大限の範囲において、当社は、逸失利益、データの消失、同期の遅延、通知の不達、フレンド接続の不具合、広告の表示、課金のエラー、第三者サービスの障害、間接損害、特別損害、付随的損害、懲罰的損害について責任を負いません。

To the maximum extent permitted by law, we are not liable for lost profits, data loss, sync delays, failed notifications, friend connection issues, ad display, purchase errors, third-party service failures, or indirect, special, incidental, consequential, or punitive damages.

法令上、責任の上限を定めることが認められる範囲では、当社の累計の賠償責任は、請求の原因が発生する前の12か月間にユーザーがフロッターに対して実際に支払った金額を上限とします。ただし、強行法規によって制限できない責任については、この上限は適用されません。

Where a monetary cap is permitted by law, our total liability is limited to the amount you actually paid for the service in the 12 months before the claim arose. This cap does not apply where liability cannot be limited under mandatory law.

11. 補償 11. Indemnity

適用される法令で認められる範囲において、ユーザーは、本規約への違反、法令への違反、第三者の権利の侵害、またはサービスの不正利用に起因して生じた請求、損失、費用について、当社および関係者を防御し、補償するものとします。

To the extent permitted by law, you agree to defend, indemnify, and hold harmless us and our affiliates from any claims, losses, and expenses arising from your breach of these Terms, violation of law, infringement of third-party rights, or misuse of the service.

12. 準拠法と紛争解決 12. Governing Law and Disputes

当社は日本に拠点を置いており、本規約の解釈には日本法が適用されます。ただし、お住まいの国や地域の消費者保護法やその他の強行法規によってユーザーに認められる権利は、本規約の内容にかかわらず保護されます。

We are based in Japan, and these Terms are governed by Japanese law. However, your rights under mandatory consumer protection or other non-waivable laws in your country or region are preserved regardless of these Terms.

本規約またはフロッターに関して紛争が生じた場合は、まず誠実に話し合いによる解決を試みるものとします。話し合いで解決できない場合、日本国内にお住まいの方については東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所とします。日本国外にお住まいの方については、お住まいの地域の適用法令に基づき、管轄裁判所が決定されます。

If a dispute arises regarding these Terms or Furotter, we will first try to resolve it through good-faith discussion. If that is not successful, users residing in Japan agree to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court for first-instance proceedings. For users outside Japan, jurisdiction will be determined in accordance with the applicable laws of your region.

13. 規約の変更 13. Changes to These Terms

当社は、法令の改正、機能の追加、価格の変更、運営上の必要に応じて、事前の通知なく本規約を更新することがあります。変更後の規約は、本ページに掲載された時点で効力を生じます。重要な変更については、可能な限りアプリ内の通知、ストアの掲載情報、本ページなどでお知らせするよう努めますが、すべての変更について個別に通知することを保証するものではありません。最新の規約は本ページでいつでもご確認いただけます。変更後にフロッターを引き続きご利用いただいた場合、更新後の規約に同意したものとみなされることがあります。

We may update these Terms at any time without prior notice to reflect legal changes, new features, pricing updates, or operational needs. Updated Terms become effective when posted on this page. While we will endeavor to notify you of material changes through the app, the app store listing, or this page, we do not guarantee individual notice for every change. You can always review the latest Terms on this page. Your continued use of Furotter after the effective date may constitute acceptance where permitted by law.

14. 一般条項 14. General Provisions

• 分離可能性: 本規約のいずれかの条項が無効または執行不能と判断された場合でも、その他の条項はなお有効に存続します。無効とされた条項は、その趣旨にできる限り沿う形で解釈または修正されます。
• 権利の不放棄: 当社が本規約上の権利を行使しなかったとしても、その権利を放棄したことにはなりません。
• 完全合意: 本規約およびプライバシーポリシーは、フロッターの利用に関するユーザーと当社の間の合意のすべてを構成し、これに関する従前の合意や了解に優先します。

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be interpreted or modified to the extent necessary to reflect its original intent.
• No Waiver: Our failure to exercise any right under these Terms does not constitute a waiver of that right.
• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us regarding your use of Furotter, superseding any prior agreements or understandings on this subject.
