利用規約 Terms of Service

1. 適用と同意 1. Acceptance and Scope

アプリをダウンロード、インストール、閲覧、または利用することにより、ユーザーは本規約および関連ポリシーに同意したものとみなされます。ユーザーが未成年である場合は、適用法が求める範囲で保護者または法定代理人の同意を得て利用してください。

By downloading, installing, accessing, or using the app, you agree to these Terms and related policies. If you are a minor, you must use the app only with any consent or authorization required by applicable law from a parent or legal guardian.

2. ライセンスと利用条件 2. License and Permitted Use

当社は、ユーザーに対し、個人的かつ非独占的、譲渡不能、取消可能な限定ライセンスを付与します。ユーザーは、法令、本規約、アプリストア規約、および第三者の権利を遵守して利用するものとします。

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the app. You must use the app in compliance with applicable law, these Terms, platform store rules, and third-party rights.

3. 禁止事項 3. Prohibited Conduct

• 法令違反、詐欺、不正アクセス、リバースエンジニアリング、セキュリティ回避
• 広告表示、課金処理、利用制限、ランキング、計測の改ざんや回避
• 知的財産権、肖像権、プライバシー権その他の権利侵害
• 有害コードの配布、過度な負荷、サービス運営妨害、データの不正収集
• ストアポリシー、輸出規制、制裁法令、公序良俗に反する利用

• Violating laws, committing fraud, unauthorized access, reverse engineering, or bypassing security
• Tampering with or circumventing ads, purchase flows, usage limits, rankings, or measurement systems
• Infringing intellectual property, publicity, privacy, or other rights
• Distributing malicious code, creating excessive load, disrupting operations, or collecting data improperly
• Using the app in violation of store policies, export controls, sanctions laws, or public order standards

4. アカウントとユーザー提供コンテンツ 4. Accounts and User Content

アカウント機能がある場合、ユーザーは正確な情報を維持し、認証情報の管理責任を負います。ユーザーが投稿、送信、保存するコンテンツについては、必要な権利を保有していることを保証するものとします。

If the app supports accounts, you must keep your information accurate and maintain the security of your credentials. For any content you submit, upload, or store, you represent that you have the necessary rights to do so.

5. 課金、サブスクリプション、返金 5. Billing, Subscriptions, and Refunds

• 有料機能は、Apple App Store、Google Play、またはその他の認定販売チャネルを通じて提供される場合があります
• 価格、通貨、税金、無料トライアル、更新周期、提供内容は、購入画面またはストア表示に従います
• 自動更新型サブスクリプションは、ユーザーがストア設定で更新停止しない限り更新される場合があります
• 返金、解約、撤回権、価格変更時の通知は、適用法およびストア規約に従います
• ストアが当社の販売代理人として機能する場合、当社は完全な支払カード情報を保持しないことがあります

• Paid features may be offered through the Apple App Store, Google Play, or other authorized sales channels
• Pricing, currency, taxes, free trials, renewal periods, and feature availability are shown at checkout or in the store listing
• Auto-renewing subscriptions may renew unless you disable renewal in the relevant store settings
• Refunds, cancellations, withdrawal rights, and notice of price changes are subject to applicable law and platform rules
• Where a platform store acts as merchant of record, we may not retain your full payment card details

6. 広告と第三者サービス 6. Advertising and Third-Party Services

本サービスは広告によって支えられる場合があり、第三者 SDK、分析ツール、決済・認証・配信基盤と連携することがあります。当社は第三者サービスの内容や継続提供を保証せず、それぞれの規約やポリシーが適用される場合があります。

The service may be supported by advertising and may integrate third-party SDKs, analytics tools, payment systems, identity services, or delivery infrastructure. We do not control or guarantee third-party services, and their own terms and policies may apply.

7. 知的財産権 7. Intellectual Property

アプリ、ソフトウェア、デザイン、商標、文書、テキスト、画像、データベースその他の関連権利は、当社または正当な権利者に帰属します。本規約は、明示された利用ライセンスを除き、いかなる権利移転も意味しません。

The app, software, design, trademarks, documentation, text, graphics, databases, and related rights belong to us or our licensors. These Terms do not transfer any ownership rights except for the limited license expressly granted.

8. サービス変更、停止、終了 8. Service Changes, Suspension, and Termination

当社は、保守、セキュリティ、法令対応、運営上の必要に応じて、機能、価格、広告提供方法、利用可能地域、対応端末、サポート内容を変更し、またはサービスの全部もしくは一部を停止・終了することがあります。ユーザーが本規約に違反した場合、当社はアクセス制限や利用停止を行うことがあります。

We may change features, pricing, ad delivery methods, availability by region, supported devices, or support offerings, and may suspend or discontinue all or part of the service for maintenance, security, legal compliance, or operational reasons. If you breach these Terms, we may restrict or terminate access.

9. 保証の否認 9. Disclaimer of Warranties

適用法で禁止されない範囲で、本サービスは「現状有姿」かつ「提供可能な範囲」で提供されます。当社は、可用性、正確性、完全性、特定目的適合性、非侵害性、無中断性、エラー非発生性、収益性その他について明示または黙示の保証を行いません。

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. We disclaim express and implied warranties, including availability, accuracy, completeness, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free performance, and commercial results.

10. 責任制限 10. Limitation of Liability

適用法で許容される最大限の範囲で、当社は、逸失利益、データ喪失、事業中断、間接損害、特別損害、付随的損害、懲罰的損害について責任を負いません。法令上制限が認められる範囲では、当社の総責任額は、請求原因発生前12か月間にユーザーが当社サービスに対して実際に支払った金額を上限とします。ただし、強行法規により制限できない責任には適用されません。

To the maximum extent permitted by law, we are not liable for lost profits, lost data, business interruption, or indirect, special, incidental, consequential, or punitive damages. Where a monetary cap is allowed, our aggregate liability is limited to the amount you actually paid for the service in the 12 months before the claim arose. This does not apply where liability cannot be limited under mandatory law.

11. 補償 11. Indemnity

適用法で認められる範囲で、ユーザーは、本規約違反、法令違反、第三者権利侵害、または不正利用に起因して生じる請求、損失、費用から当社および関係者を防御し補償するものとします。

To the extent permitted by law, you agree to defend, indemnify, and hold harmless us and our affiliates from claims, losses, and expenses arising from your breach of these Terms, violation of law, infringement of third-party rights, or misuse of the service.

12. 準拠法と紛争解決 12. Governing Law and Disputes

本規約は、抵触法ルールを除き、当社の主たる事業拠点所在地の法律に準拠します。ただし、消費者保護法その他の強行法規により、ユーザー居住地の法令や裁判管轄が優先される場合があります。紛争は、まず誠実に協議して解決を試みるものとします。

These Terms are governed by the laws of the jurisdiction where our principal place of business is located, excluding conflict-of-laws rules. However, consumer protection and other mandatory laws in your place of residence may still apply. The parties will first attempt to resolve disputes in good faith.

13. 規約変更 13. Changes to These Terms

当社は、法令改正、機能追加、価格変更、運営上の必要に応じて本規約を更新することがあります。重要な変更については、アプリ内、ストア掲載情報、本ページ等で合理的な通知を行います。変更後にサービスを利用した場合、更新後の規約に同意したものとみなされることがあります。

We may update these Terms to reflect legal changes, new features, pricing updates, or operational needs. If changes are material, we will provide reasonable notice through the app, the app store listing, this page, or another appropriate method. Your continued use after the effective date may constitute acceptance where permitted by law.
